1. Scope
These Terms and Conditions apply to all orders placed by consumers through the online shop of

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.
2. Contract Partner and Conclusion of Contract
The purchase contract is concluded with GEAR Berlin GmbH.
The presentation of products in the online shop does not constitute a legally binding offer but a non-binding product catalog.
By clicking the button “place order with obligation to pay”, you submit a binding order for the goods contained in the shopping cart.
Confirmation of receipt of your order is sent automatically by email immediately after the order is submitted. This confirmation does not yet constitute acceptance of the contract.
The purchase contract is concluded only when we:
- send an explicit order confirmation, or
- dispatch the goods.
3. Prices and Shipping Costs
All prices shown are final prices and include applicable value added tax (VAT).
Additional shipping costs may apply. These will be clearly displayed during the checkout process.
4. Delivery
Delivery is made to the address specified by the customer during the ordering process.
Delivery times are indicated on the respective product pages.
If a product ordered is not available, we reserve the right not to accept the order. In such cases, the customer will be informed immediately and any payments already made will be refunded.
5. Payment
Payment is made using the payment methods offered in the online shop, including for example:
- credit card
- PayPal
- Klarna
- other payment methods offered through Shopify
Payment is processed immediately upon completion of the order.
6. Retention of Title
The goods remain our property until full payment has been received.
7. Right of Withdrawal
Consumers have a statutory right of withdrawal.
The details and conditions of the right of withdrawal are provided in our separate Withdrawal Policy.
8. Returns
You have the right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which you or a third party designated by you takes possession of the goods.
To exercise your right of withdrawal, you must inform us of your decision by means of a clear statement.
9. Return Shipping Costs
The direct costs of returning the goods shall be borne by the customer.
10. Condition of Returned Goods
To be eligible for a return, the item must:
- be unused
- be in the same condition in which it was received
- be returned in the original packaging
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
11. Refunds
Once we have received and inspected the returned goods, we will notify you by email.
If the refund is approved, it will be processed using the original payment method.
Please allow several business days for the refund to appear on your account.
12. Warranty
The statutory warranty rights apply.
13. Liability
We are fully liable for damages resulting from injury to life, body, or health.
For other damages, we are liable only in cases of intent or gross negligence.
In the event of slight negligence in the breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract.
Liability under the German Product Liability Act remains unaffected.
14. External Links
Our website may contain links to external third-party websites. We have no influence over the content of these websites and therefore cannot assume any responsibility for them.
15. Applicable Law
The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If the customer is a consumer and has their habitual residence in another country, mandatory consumer protection provisions of that country remain unaffected.
16. Severability Clause
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain unaffected.
